Can Americans Get Married in England? A quick guide to what you need to know

If you’re dreaming of saying ‘I do’ in an English country house setting. An historic castle or beneath centuries-old oak trees.

You’re certainly not alone.

Many couples from across the United States, and around the globe, fall in love with England’s timeless charm and choose it as the backdrop  to host their  wedding.

One of the first topics of conversation that mainly arises is:  “Can Americans legally get married in England?”

The simple answer is Yes – American citizens can legally marry in England, even if they don’t live in the UK.

You need to be aware that there isn’t a quick or simplified process for overseas visitors wishing to marrying in the UK. As there are legal requirements to work around including visa applications, notice periods and licenced approved wedding venues that need to be carefully explored and planned in advance.

This you would expect and will need to understand more about before deciding whether a legal wedding ceremony in England is therefore the right choice for you.

Option One: A Legal Wedding Ceremony in England

If you’ve always imagined saying “I do” and becoming legally married on your wedding day itself.  A legal wedding ceremony in England may be the perfect choice.

To marry legally in England as an American couple, you’ll typically need to:

  • Apply for the correct visa, usually a Marriage Visitor Visa
  • Attend an appointment at a local Register Office
  • Give Notice before your wedding ceremony
  • Secure a UK wedding venue specifically licensed as an approved premise for hosting legal wedding ceremonies

All these steps take time will take time and patience. Plus, you will need to travel to England before your wedding. See FAQs at the end of this article for more details.

With careful planning, it is achievable and many couples love the significance of making their marriage legally official on the day they say “I Do”.  There is also the bonus that whilst in the UK during this time, further wedding planning decisions can be handled. Such a food tasting & wine pairing sessions. Bridal gown & suit fittings. Amongst other elements can be taken care of during your trip to England.

Below are a few Key Requirements for Non-UK Residents wishing to legally marry in England

  • Residency: Both parties must be physically present in the UK for 7 clear days and nights before you can give notice. The day you arrive and the day of your appointment do not count toward this 7-day total.
  • Visas: You cannot give notice or get legally married on a Standard Visitor Visa. You must apply for the appropriate visa before entering the UK, such as a Marriage Visitor Visa or a Fiancé Visa.
  • Notice Period: Your notice will normally be displayed at the register office for 28 days. However, if you or your partner are foreign nationals subject to immigration control, the Home Office can extend this waiting period to 70 clear days.

For many couples, the whole legal process is worth the time, effort and additional expense.

However, for others considering hosting a wedding in England. Opting for a legal ceremony back home in the States, or wherever in the world home maybe, and celebrating with a symbolic ceremony in England offers greater flexibility and appeal

Option Two: Marry Legally in the US and Celebrate in England

By far the most popular option not only for many American couples choosing to host their wedding in the UK. But also for other non-UK residents.

You’ll complete the legal paperwork & marry in the United States (or elsewhere you call home). Then enjoy a beautiful symbolic wedding ceremony in England surrounded by your family and friends.

We can even create the illusion that it is your legal ceremony and none of the guests will be any the wiser.

What is the beauty of hosting a celebrant led wedding ceremony? It is that you can truly tailor the feel, vows & whole wedding ceremony to truly reflect you both. It will be every bit as meaningful, emotional and unforgettable. Simply without the legal element.

There are several advantages to hosting a celebrant led wedding ceremony:

  • No UK marriage paperwork to complete
  • No notice appointments to schedule
  • No residency requirements to consider
  • Greater flexibility with your travel plans (especially pre wedding)
  • More freedom when choosing your desired English wedding venue

Many of England’s most breathtaking private estates and exclusive venues either aren’t licensed for legal ceremonies. Or offer greater flexibility for those hosting a celebrant-led wedding.

Choosing a symbolic wedding ceremony offers complete freedom to create a ceremony that feels unmistakably yours. From personally written vows and cherished family traditions to favourite readings, music and meaningful rituals. Every element can be shaped around your story, without the restrictions to come with a legal ceremony.

Which Option Is Right for You Though?

Honestly there isn’t a right or wrong answer to this question. It is purely what feels and works best for you. Some couples love the idea of legally marrying in England, surrounded by the history and romance of the place they’ve chosen.

Whilst others prefer to complete the legalities at home and enjoy the complete freedom when curating their wedding here in England with a symbolic ceremony.

As your UK based wedding planner, Weddings By Mary* can help you understand & navigate both options so you can decide on the one that truly feels right for you.

*You will however have to handle the legalities if you decide on that route as this is not an element that Weddings By Mary (nor any other wedding planner) can undertake for you.

What is a Marriage Visitor Visa?

A Marriage Visitor Visa is required if you are traveling to the UK to marry but plan to return to your home country afterward.

Both parties must sign a legal statement at the register office covering the district where you are staying whilst in the UK to confirm your intent to marry. This is a legal requirement known as Giving Notice.

How far in advance do you need to Give Notice of Marriage in the UK?

You must give notice of marriage at least 29 days before your ceremony. Although you can give notice up to 12 months in advance.

You must reside in England for 7 consecutive nights immediately before you can give notice of marriage. The day you arrive and the day of your notice appointment do not count toward this total.

You as the happy couple must contact the register office that covers your chosen wedding venue’s district to ensure registrars are available to officiate at your specific date and time.

Do Americans Need a Visa to Get Married in England?

If you’re planning a legal wedding in England, yes.

You’ll need to apply for a Marriage Visitor Visa before travelling to the UK. You cannot arrive as a tourist and decide to marry legally.

Visa applications will be required to be arranged well in advance.

However, if you’re holding a symbolic ceremony after legally marrying in the US, a standard visitor entry is generally sufficient for you to host your wedding celebrations in England.

Do wedding guests travelling from the USA to the UK require a visa?

U.S. citizens do not need a traditional physical visa for short visits (up to 6 months) to the UK.

Instead, they must apply for an Electronic Travel Authorisation (ETA) before travelling. This requirement applies whether visiting for a vacation, family, business, or transiting through.

Important Notice: The information within this article is intended as a helpful guide and reflects UK marriage requirements at the time of writing. As visa and marriage regulations can change, it is recommended to always check the latest UK Government guidance before making any legal decisions and arrangements for your wedding.
