Can we legally marry in an English church if we don’t reside in the UK?

The answer is Yes.

However, as you can appreciate there will be several legal requirements you’ll need to meet and understand before you decide on a church wedding in England.

When it comes to answering the question can overseas couples get married in an English church? Below outlines the details. As well as some of the legalities to give you a better insight & understanding of the procedures.

Couples living outside the UK, including from the United States, Australia, and many other countries, can legally marry in a Church of England church.  However, you’ll need to demonstrate what’s known as a Qualifying Connection with the church you would like to legally marry.

What Is a Qualifying Connection?

A qualifying connection for a church wedding in England means that you have a genuine historical. Or family link with the parish where you’d like to marry.

There are 7 qualifying connections, and you may already qualify if either of you:

  1. Previously lived in the parish for at least six months
  2. Were baptised (christened) in the parish church
  3. Were confirmed there
  4. Regularly attended services there for at least six months
  5. Have a parent who previously lived in the parish
  6. Have a parent who regularly worshipped there
  7. Have parents or grandparents who were themselves married in that church

It’s these family connections for many overseas couples, that make marrying in England meaningful and special.

What If We Don’t Have a Qualifying Connection?

If you don’t have a qualifying connection, you may still be able to create one.

The main option being number 4. Which is to attend services at your chosen Church of England church at least once each month for six consecutive months.

This however, and being realistic, does prove to be a rather large undertaking & huge commitment. As it would potentially mean travelling to the UK each month, for 6 months at least, to attend a service.

You’ll also need to allow additional time for the legal preliminaries after this 6 month period. Therefore, speaking with the vicar of the parish Church as early as possible is the essential first step.

Every church is different, and the vicar at your chosen church will be able to explain more clearly and concisely the options available to you.

Can Americans Get Married in an English Church?

Many couples travel from the United States specifically to marry in England. Often because of family history or personal connections to a particular church.

While American citizens can legally marry in an English church. The legal process differs slightly from that of UK residents.

Rather than marrying by the traditional publication of banns, most overseas couples will require a Superintendent Registrar’s Marriage Schedule (SRMS) before the church wedding service can legally take place.

What Paperwork Will We Need?

If either of you is not a British (or Irish national) and don’t hold Settled or Pre-settled Status under the EU Settlement Scheme  Your vicar will guide you through the additional paperwork required.

In most cases this includes:

  • Providing evidence of your qualifying connection (as mentioned above)
  • Showing your passports and identification
  • Applying for a Superintendent Registrar’s Marriage Schedule (SRMS)
  • Giving legal notice of your marriage at the relevant Register Office after meeting the residency requirements

The Register Office will normally display your notice for 28 days before issuing the SRMS, provided there are no legal objections.

In some circumstances, where immigration checks are required, this notice period may be extended to 70 days.

Will We Need a Marriage Visitor Visa?

If you’re travelling to England specifically to get married and won’t be living in the UK afterwards. You’ll usually need to apply for a Marriage Visitor Visa before travelling.

A Standard Visitor Visa does not permit you to give notice or legally marry in England.

This is one of the reasons why as a UK based wedding planner I encourage overseas couples to make this important decision as early as possible. Allowing plenty of time for visas, legal documentation and church arrangements to be made.

Planning a Wedding in England

As you have discovered planning a church wedding from overseas is very involved and paperwork heavy. It’s more than simply finding your quintessential English church & securing a date.

There is legal documentation to prepare. Conversations with the vicar to be had. Timelines to coordinate, travel plans to be made and much of this will happen before you have even considered the setting for your wedding reception.

As well as the florals you’ll choose. The stationery design, the guests you’ll invite or any of the other 10 plus wedding vendors to be secured to bring your wedding in England to life.

When planning your wedding in England from another country, all these moving parts can quickly become overwhelming. Especially without someone here on the ground helping to coordinate everything on your behalf.

The time difference between where in the world you are based to speaking with UK based wedding vendors is also a consideration.

Understanding therefore all your options for a legal wedding ceremony in England is important.

Whether you opt for a Church of England wedding service. A wedding ceremony at a licensed wedding venue conducted by a Registrar.

Or you, like many overseas couples, you opt for a legal ceremony in your home country and host a beautiful symbolic ceremony here in the UK.
